I. General Provisions and Contact Details
1. These Terms and Conditions (hereinafter: the “Terms”) set out the rules and conditions for using the online store Czerwona Twierdza – board games, operating at https://czerwonatwierdza.pl (hereinafter: the “Store”).
2. The owner of the Store is Czerwona Twierdza sp. z o.o., with its registered office at Zielona 29/1, 05-270 Marki, Poland, entered into the National Court Register under KRS number 0001122564, NIP 1251772717 (hereinafter: the “Seller”).

II. Technical Requirements
1. To use the Store, the following are required:
1.1. A computer or device with a web browser.
1.2. Internet access.
1.3. An active email address.
III. Personal Data
1. The Seller is the controller of customers’ personal data.
2. Detailed information regarding data processing is available in the Privacy Policy.
IV. Conclusion of Sales Contract, Customer Account
1. Products (“Goods”) may be purchased:
1.1. Without registration.
1.2. With a Store account.
2. Product information (descriptions and prices) constitutes an invitation to conclude a contract under Article 71 of the Polish Civil Code.
3. Placing an order requires completing all mandatory data fields.
4. Account registration is one-time and based on email and password. Account details are governed by the Account Terms.
5. The Customer may delete their Account at any time free of charge via email.
6. Clicking “Buy and Pay” constitutes:
6.1. Submission of an offer to purchase Goods.
6.2. Acceptance of the obligation to pay the price and delivery costs.
7. The sales contract (“Contract”) is concluded upon confirmation of order acceptance by the Seller via email.
8. If the order cannot be fulfilled, the Customer will be informed and any payment refunded accordingly.
9. The Seller provides confirmation of the Contract on a durable medium no later than upon delivery.
10. The Seller is not responsible for delivery issues resulting from incorrect Customer data.
11. The Seller may suspend order processing if provided data appears false or doubtful.
V. Prices and Payment Methods
1. All prices are in PLN and include VAT.
2. Delivery costs are indicated separately in the cart.
3. Available payment methods are listed in the “Payment Methods” section.
4. Payment options include:
4.1. Instant transfer / BLIK / digital wallet via Przelewy24.
4.2. Cash on delivery.
4.3. Deferred payment via indicated operator.
5. If standard bank transfer is selected, payment must be made within 1 day. Otherwise, the Contract is considered not concluded.
6. Online payments via Shoper Payments are handled by Autopay S.A.
VI. Delivery
1. Delivery methods:
1.1. InPost courier.
1.2. InPost parcel lockers.
1.3. ORLEN Paczka.
2. Orders are considered fulfilled upon dispatch to the carrier.
3. Shipping time is up to 21 business days unless otherwise stated.
4. Standard delivery is available within Poland.
VII. Withdrawal from Contract
1. Consumers and Privileged Entrepreneurs may withdraw within 30 days without reason.
2. Withdrawal statement must be sent via email or post.
3. Returned Goods must be sent within 7 days at the Customer’s expense.
4. Refund includes:
4.1. Product price.
4.2. Standard delivery cost (cheapest available option).
5. Refunds are issued within 14 days.
6. Seller may withhold refund until Goods are returned or proof of dispatch is provided.
7. Refunds are made using the original payment method unless otherwise agreed.
8. The Customer is liable for diminished value if Goods were used beyond necessary inspection.
Special Orders
Goods imported on individual request are not subject to withdrawal under Article 38(3) of the Polish Consumer Rights Act.
Customers are informed of special order status before purchase.
Gift Cards
9. Gift cards are non-refundable and non-exchangeable for cash.
10. Refunds for purchases made with gift cards are issued as gift card credit only.
VIII. Exceptions to Withdrawal
1. If original shrink wrap or seal is removed beyond necessary inspection, the refund may be reduced proportionally.
IX. Complaints
1. The Seller must deliver Goods compliant with the Contract.
2. Liability toward Consumers and Privileged Entrepreneurs follows the Consumer Rights Act.
3. Complaints may be submitted via:

4. Complaints are processed within 14 days.
5. Consumers may use out-of-court dispute resolution methods, including mediation, consumer ombudsman, ODR platform, or consumer arbitration court.
X. Product Reviews
1. Customers may submit product reviews.
2. Reviews must comply with the Digital Services Act (DSA) and good practices.
3. Illegal, offensive, commercial, or rights-infringing content is prohibited.
4. The Seller may moderate and remove non-compliant reviews.
5. Appeals may be submitted within 14 days.
6. Any visitor may report illegal content via email.
7. The Seller is not liable for user reviews if unaware of illegality and acts promptly upon notice.
XI. Final Provisions
1. Polish law applies. Contracts are concluded in Polish.
2. Nothing in these Terms limits consumer rights under mandatory law.
3. Amendments apply to orders placed after publication. Account holders will be informed of changes.
4. These Terms are effective as of 16 October 2025.
