§ 1 DEFINITIONS

Consumer – a Service Recipient who is a natural person entering into the Agreement (or taking steps to conclude it) not directly related to their business or professional activity.

Newsletter – information regarding the Store, including offers, promotions, and new products, provided free of charge to the Service Recipient by the Service Provider under the Agreement, constituting digital content within the meaning of the Polish Consumer Rights Act.

Privileged Entrepreneur – a natural person entering into the Agreement directly related to their business activity, but not of a professional nature for them.

Terms – these Terms and Conditions.

Store – the online store Czerwona Twierdza – board games, operated at https://czerwonatwierdza.pl.

Agreement – the agreement for the provision of the Newsletter service.

Service Recipient – any entity that has concluded the Agreement or takes steps to conclude it.

Privileged Service Recipient – a Consumer or a Privileged Entrepreneur.

Service Provider – Czerwona Twierdza Sp. z o.o., entered into the National Court Register (KRS 0001122564), NIP 1251772717, REGON 529427708, with its registered office at Zielona 29/1, 05-270 Marki, Poland.

Consumer Rights Act – the Polish Act of 30 May 2014 on Consumer Rights.

 


§ 2 CONTACT WITH THE SERVICE PROVIDER

The cost of telephone calls or data transmission is determined by the Service Recipient’s telecom operator. International charges may be higher depending on the operator’s tariff.

 


§ 3 TECHNICAL REQUIREMENTS

To use the digital content covered by these Terms, you need:

• an active email account
• a device with Internet access
• a web browser supporting JavaScript and cookies

 


§ 4 AGREEMENT

Subscription to the Newsletter is voluntary.

To receive the Newsletter, the Agreement must be concluded.

Emails will be sent to the address provided at the time of subscription.

The Agreement is concluded for an indefinite period upon subscription. The Service Provider begins providing the Newsletter immediately.

The Service Recipient must provide a valid email address.

Each Newsletter email includes information on how to unsubscribe.

The Service Recipient may unsubscribe at any time without providing a reason or incurring any costs by using the unsubscribe link or by sending an email to the address provided in § 2.

Unsubscribing results in immediate termination of the Agreement.

 


§ 5 RIGHT OF WITHDRAWAL

A Privileged Service Recipient may withdraw from the Agreement at any time without providing a reason.

Withdrawal may be made via email or by using the unsubscribe link included in the Newsletter.

 


§ 6 PERSONAL DATA

The controller of personal data provided in connection with the Newsletter is the Service Provider.

Detailed information regarding personal data processing is available in the Store’s Privacy Policy.

Personal data is processed for the following purposes:

• performance of the Agreement (Art. 6(1)(b) GDPR)
• analysis of Newsletter effectiveness (legitimate interest – Art. 6(1)(f) GDPR)
• establishment, defense, or pursuit of claims (Art. 6(1)(f) GDPR)

Providing data is voluntary but necessary to conclude the Agreement and receive the Newsletter.

Data will be processed until:

• the Agreement is terminated
• the limitation period for claims expires
• a valid objection is accepted

The Service Recipient has the right to:

• access data
• rectify data
• erase data
• restrict processing
• data portability
• object to processing based on legitimate interest

If data is processed unlawfully, a complaint may be lodged with the Polish Data Protection Authority (UODO).

 


§ 7 AMENDMENTS TO THE TERMS OR NEWSLETTER

The Service Provider may amend these Terms only for valid reasons, including:

• changes in Newsletter functionality
• changes in applicable law
• adjustments required by public authorities
• changes in contact or identification details

Information about planned changes will be sent at least 7 days in advance.

If the Service Recipient does not object before the changes take effect, the changes are deemed accepted.

If the Service Recipient does not accept the changes, they may terminate the Agreement by notifying the Service Provider.

Changes to the Newsletter that significantly and negatively affect access or use will be communicated in advance, including information about rights related to such changes.
