§ 1 DEFINITIONS

Consumer – a Service Recipient who is a natural person concluding an Account agreement under these Terms (or taking steps to conclude it), not directly related to their business or professional activity.

Account – a digital service within the meaning of the Polish Consumer Rights Act, provided free of charge electronically by the Service Provider to the Service Recipient, enabling access to additional Store features.

Loyalty Program – a program operated by the Service Provider within the Store, under which Account holders may collect and use Points according to these Terms.

Points – loyalty points awarded to the Service Recipient under the Loyalty Program rules, enabling discounts on selected Store products.

Privileged Entrepreneur – a natural person concluding an Account agreement directly related to their business activity but not of a professional nature for them.

Terms – these Account Terms and Conditions.

Store – the online store Czerwona Twierdza – board games, operated at https://czerwonatwierdza.pl.

Service Recipient – any entity that has concluded or seeks to conclude an Account agreement.

Privileged Service Recipient – a Consumer or Privileged Entrepreneur.

Service Provider – Czerwona Twierdza Sp. z o.o., with its registered office at ul. Zielona 29/1, 05-270 Marki, Poland, entered in the National Court Register (KRS 0001122564), NIP 1251772717, REGON 529427708, share capital: PLN 5,000.

Consumer Rights Act – the Polish Act of 30 May 2014 on Consumer Rights.

 


§ 2 CONTACT WITH THE SERVICE PROVIDER

Call or data transmission costs depend on the Service Recipient’s telecom provider. International charges may be higher.

 


§ 3 TECHNICAL REQUIREMENTS

To create and use an Account, you need:

• an active email account
• a device with Internet access
• a browser supporting JavaScript and cookies

 


§ 4 ACCOUNT

Creating an Account is voluntary.

An Account enables:

• viewing order history
• checking order status
• editing personal data
• participation in the Loyalty Program

After creating an Account, the Service Recipient receives a 3% discount on their first order.

The Account agreement is concluded for an indefinite period upon registration.

The Service Provider begins providing the Account service immediately.

The Service Recipient may delete the Account at any time free of charge by emailing the Service Provider. Deleting the Account terminates the agreement.

 


LOYALTY PROGRAM

Participation requires an active Account.

For every PLN 1 spent in a single order, the Service Recipient receives 1 Point (excluding shipping costs and payments made with Points).

Points are awarded only for successfully paid and completed orders.

10 Points are awarded for submitting a product review.

Points are accumulated in a single pool visible in the Account.

Discount thresholds:

3% discount after collecting 100 Points
4% discount after collecting 5,000 Points
5% discount after collecting 8,000 Points

Discounts do not accumulate.

Discounts apply automatically to product prices (excluding items marked “Promotion” or “Special Offer”).

The Service Provider may cancel Points in cases such as refunded orders, unpaid orders, or duplicate newsletter sign-ups.

Points cannot be exchanged for cash, transferred, or sold.


§ 5 COMPLAINTS

Complaints regarding the Account should be sent to: reklamacje@czerwonatwierdza.pl

The Service Provider will respond within 14 days.

 


§ 6 RIGHT OF WITHDRAWAL

A Privileged Service Recipient may withdraw from the Account agreement within 14 days of its conclusion without providing a reason.

Withdrawal must be communicated via email or in writing.

 


§ 7 PERSONAL DATA

The Service Provider is the data controller.

Data is processed for Account management (Art. 6(1)(b) GDPR) and for legitimate interests such as defending potential claims (Art. 6(1)(f) GDPR).

Providing data is voluntary but necessary to create and maintain the Account.

The Service Recipient has the right to:

• access
• rectification
• erasure
• restriction
• data portability
• objection

Complaints may be filed with the Polish Data Protection Authority (UODO).

 


§ 8 AMENDMENTS TO THE TERMS OR ACCOUNT

The Service Provider may amend these Terms for valid reasons, including changes in law, functionality, or company details.

Information about changes will be sent at least one month in advance.

If the Service Recipient does not object before the effective date, the changes are deemed accepted.

If changes significantly affect Account access, prior notice will be provided along with information about related rights.

 


§ 9 FINAL PROVISIONS

Unlawful content submission is prohibited.

The Account agreement is concluded in Polish.

Polish law applies, subject to mandatory consumer protections.

Disputes with non-privileged Service Recipients fall under the jurisdiction of the court competent for the Service Provider’s registered office.

To the extent permitted by law, the Service Provider’s liability toward non-privileged Service Recipients is excluded.
